The four principles approach to medical ethics plus specification is used in this paper. Specification is defined as a process of reducing the indeterminateness of general norms to give them increased action guiding capacity, while retaining the moral commitments in the original norm. Since questions of method are central to the symposium, the paper begins with four observations about method in moral reasoning and case analysis. Three of the four scenarios are dealt with. It is concluded in the “standard” Jehovah’s (...) Witness case that having autonomously chosen the authority of his religious institution, a Jehovah’s Witness has a reasonable basis on which to refuse a recommended blood transfusion. The author’s view of the child of a Jehovah’s Witness scenario is that it is morally required—not merely permitted—to overrule this parental refusal of treatment. It is argued in the selling kidneys for transplantation scenario that a fair system of regulating and monitoring would be better than the present system which the author believes to be a shameful failure. This report had been requested in May 1997 by the Department of Health and Human Services (DHHS). We will here describe the genesis of the IOM (...) report, the medical and moral concerns that led the DHHS to sponsor it, the process of producing it, and its conclusions. The analyses, findings, and recommendations of the report are also reviewed, in particular the central issues that led to suggestions for policy changes.Transplantation BackgroundAs a first step, some background in the relevant aspects of organ transplantation will prove useful. For the purposes of this analysis, “transplantation” involves the transfer of cells, tissues, or solid organs from one human to another to replace the structure or function of comparable body components that, through injury or disease, are defective or of inadequate function. The IOM report deals with solid organs, primarily kidneys and livers, whose blood supply is reconnected in the organ recipient, in contrast to cells, like bone marrow, and tissues, like corneas. A variety of donor types exists for organ transplantation, each with particular medical and scientific conditions.Living donors are healthy (and usually genetically related) individuals who volunteer to provide either a whole, paired organ such as a kidney or a section of an organ such as a liver. Cadaver donors are individuals who have died and from whom a full array of organs can be taken. “Heart-beating” cadaver donors are individuals who have suffered “brain death,” that is, irreversible cessation of function of the whole brain including the brain stem; and “non-heart-beating” donors (NHBDs) are individuals who are ill or injured, but not “brain dead,” and who have suffered cardiopulmonary death, that is, irreversible cessation of cardiac and respiratory function. NHBDs can be “controlled,” which means that [End Page 83] they can be sustained by artificial life support systems until a medical and family decision is made to terminate futile life support. This can be done at a scheduled time and in a controlled manner, and organs can then be recovered for transplantation. NHBDs can also be “uncontrolled,” which means that their hearts and breathing have stopped through disease or injury at an unexpected time or in an uncontrolled manner, and they cannot be resuscitated; the organs of some individuals of this description can be recovered for transplantation. The stability of the perfect screw dislocation in silicon has been investigated using both classical potentials and first-principles calculations. Although a recent study by Koizumi et al . stated that the stable screw dislocation was located in both the 'shuffle' and the 'glide' sets of {111} planes, it is shown that this result depends on the classical potential used, and that the most stable configuration belongs to the 'shuffle' set only, in the centre of one hexagon. We also investigated the (...) stability of an sp 2 hybridization in the core of the dislocation, obtained for one metastable configuration in the 'glide' set. The core structures are characterized in several ways, with a description of the three-dimensional structure, differential displacement maps and derivatives of the disregistry. (shrink)

In this book, T. L. Short corrects widespread misconceptions of Peirce's theory of signs and demonstrates its relevance to contemporary analytic philosophy of language, mind and science. Peirce's theory of mind, naturalistic but nonreductive, bears on debates of Fodor and Millikan, among others. His theory of inquiry avoids foundationalism and subjectivism, while his account of reference anticipated views of Kripke and Putnam. Peirce's realism falls between 'internal' and 'metaphysical' realism and is more satisfactory than either. His pragmatism is not verificationism; (...) rather, it identifies meaning with potential growth of knowledge. Short distinguishes Peirce's mature theory of signs from his better-known but paradoxical early theory. He develops the mature theory systematically on the basis of Peirce's phenomenological categories and concept of final causation. Its scope is intended to span the full range of interests from classical problems in the philosophy of mind and philosophical psychology through issues in cognitive psychology and sociobiology (concerning the mental capabilities of other species) to ideas related to artificial intelligence and computer science. While most philosophers and psychologists tend to believe that the rise of cognitive psychology has occurred concomitant with the decline of operant psychology, Terry L. Smith contends that nothing could be further from the truth. He maintains that operant psychology has discovered (and continues to discover) reasonably well-confirmed causal principles of intentional behavior, which go beyond what cognitive psychology can provide, while cognitive psychology, in tum, has the potential to supply analyses (and explanations) that account for them. My purpose in what follows is not so much to defend the basic principle of utilitarianism as to indicate the form of it which seems most promising as a basic moral and political position. I shall take the principle of utility as offering a criterion for two different sorts of evaluation: first, the merits of acts of government, social policies, and social institutions, and secondly, the ultimate moral evaluation of the actions of individuals. I do not take it as implying (...) that the individual should live his life on the basis of constant evaluations of this sort. For there are different levels of decision making each with its appropriate criteria. For example, we each inevitably make many of our decisions from the point of view of our own personal self-fulfilment and this cannot regularly take a directly utilitarian form, nor should the utilitarian want it to do so. His claim is at most that we should sometimes review our life from the point of view of a kind of impersonal moral truth of a universalistic utilitarian character. (shrink)

This passage has caused much discussion and much variety of opinion, and it still remains doubtful whether the later commentators in their efforts at exact interpretation have been more successful than the earlier ones. The general sense is sufficiently clear. Medea is making an apology to the Chorus of sympathizing Corinthian ladies for her delay in appearing before them. So far all are agreed. The difficulties, real or unreal, arise when we begin to inquire what form the apology actually takes. (...) First of all there are doubts as to the meaning of το ς μ μᾂπο. in the Scholia. we have a gloss μῂ όρώμνο είνα. and the explanation το Xωρίςεσθα καì ᾂτν ποθεν μμάτων είνα. Many scholars have taken exception to this view on two grounds, as stated by Verrall ad loc, because ‘the sense of motion is not there, and there is no reference to any eyes in particular.’ He requires either authority or analogy for this. As far as the absence of motion is concerned, it is sufficient to refer to Thuc. 1, 7 αί δ παλααί ᾀπθαλσσης μλλον ῲκίσθησαν id I, 99ναμῄ ᾀπ οκου σ,γ. Il. B 292 μένεν ᾀπ ᾑς ᾀλòΧοο. Then there is the analogous expression αί γàρ δῂ μοᾀπ οὒατος ώδε γένοτο . As to the second objection, why is it necessary that the eyes of anyone in particular should be referred to ? There is no more ambiguity here than there is in Il Ψ 53 θâσσον ᾀπ θαλμν, where the meaning is ‘so as to be out of sight, not of me or you, but of everybody.’ In fact, it could not be maintained with any show of reason that ᾀπθαλμνand ᾀποὒατς could not mean ‘out of sight’ and ‘out of hearing’. Horace has told us that the author of a literary work, qui uariare cupit rem prodigialiter unam, falls into absurdities. Much more likely to meet this fate is the interpolator who has the same ambition. The above four lines are a case in point; for it is fairly certain that if this Hymn were presented to readers as it came from the hand of its author, the whole passage with its phenomenal bull and its four pacifist dogs which apparently had (...) agreed together not to bark and bite, ‘as is their nature to,’ would not be found in the text. Undoubtedly it is true, though it is by no means a marvel , that the bull which was somewhere else and the dogs which were following in his wake were not taken by the infant cattle-lifter who was satisfied, as he well might be, with a trifle of fifty cows. The veracity of the interpolater in this regard may, therefore, pass without question, and furthermore his knowledge of epic metre does not fail seriously till he reaches the fourth line, although ό δ ταρος is not really epic and λλων not λλων is required in the opening line, for he certainly did not mean, as he unwittingly says ‘other bulls,’ but ‘the others, the cows.’ After ο μνλειθεν it is quite out of the question that οĩ τε κύνες τε ταȗρος, two flagrant examples of the later article, should follow. These lines conclude the account of Hermes inventing the primitive method of producing fire by friction, and it is evident that the writer had in mind σ 308: περ δ ξλα κγχανα θ;καν, αα πλαι περκηλα, νον κεκεασμνα χαλκ, cf. also ε 240. Gemoll accordingly in his edition read αα λαβν, and for so doing was rebuked by Messrs. S. and A. in their best dogmatic manner: ‘Gemoll's αα cannot be accepted; ολα is sound, though the meaning is not certain.’ (...) In other words: ‘Whether ολα makes sense or nonsense, it is right.’ Finally, they say that ολα probably means ‘whole’, and this translation is, I think, confirmed by l. 137; but then it follows that the hymn-writer was flatly contradicting the κεκεασμνα in Homer's line, and knew no more about fire-lighting than these trenchant editors. Ignition fuel has a character of its own, and from this point of view Gemoll has the advantage. (shrink)

As is well known, many editors, following Valckenaer, reject the bracketed line altogether; but the omission leaves the opening clause with a very unsatisfactory ending. μπρέποντας αίθέρι, heavily stressed by its position, seems to form little less than an anticlimax, unless we assume that the stars could hardly be expected to shine in the sky. On the other hand, when line 7 is added, έμπρέποντας αίθέρ στέρας brings out clearly the fact that only certain conspicuous stars or constellations are meant—those (...) which serve as guides to the operations of agriculture and navigation, such as the Pleiades, Arcturus, and Orion, as we may see from Hesiod, Op. 609 onwards.
